1. Terms

By accessing this School, you are agreeing to be bound by these Terms of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this School are protected by applicable copyright and trademark law.

In the School, you may purchase courses, memberships and digital downloads that are hosted through Teachable, (collectively (the "Service")). Once you sign up for the Service, you will receive access to a User Account, as defined below.

To the extent the Service or any portion thereof is made available for any fee, you will be required to select a payment plan and provide JenniferMaker LLC’s third-party payment provider with information regarding your credit card or other payment instrument. You represent and warrant to JenniferMaker LLC that such information is true and that you are authorized to use the payment instrument. You will promptly update your User Account information with any changes (for example, a change in your billing address or credit card expiration date) that may occur. You agree to pay JenniferMaker LLC the amount that is specified in the payment plan in accordance with the terms of such plan and this Terms of Use. You hereby authorize JenniferMaker LLC to bill your payment instrument in advance in accordance with the terms of the applicable payment plan until you terminate your User Account, and you further agree to pay any charges so incurred. If you dispute any charges you must let JenniferMaker LLC know within thirty (30) days after the date that JenniferMaker LLC charges you. JenniferMaker LLC reserves the right to change the price of the Services. Your continued use of the Service after the price change becomes effective constitutes your agreement to pay the changed amount.

Access will be revoked without a refund to the Services if you choose a payment plan or subscription and do not complete the payments on schedule.

2. Use License

1. Permission is granted to temporarily download one copy of any downloadable materials (videos, PDFs, and text files) on the School’s website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:
   1. modify or copy the materials;
   2. use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
   3. attempt to decompile or reverse engineer any software contained on the School’s web site;
   4. remove any copyright or other proprietary notations from the materials; or
   5. transfer the materials to another person or 'mirror' the materials on any other server
2. Permission is granted to download, modify, and share SVG cut and PNG print files created by Jennifer Maker on this School's web site for any purpose, including personal or commercial use. This is a grant of a license, not a transfer of title.
3. This license shall automatically terminate if you violate any of these restrictions and may be terminated by Company at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

3. Lifetime Access

If lifetime access was stated at the time of purchase, you will have lifetime access to the version of the Service you are purchasing for as long as the Service exists. This means you are not entitled to future Service updates, bonuses, or additional content added at a later date but you will maintain access to the version of the Service you purchased as long as it exists. If the Service you purchase is retired (discontinued), you will no longer have access to it. JenniferMaker LLC cannot guarantee that notice will be provided prior to discontinuing a Service. JenniferMaker LLC reserves the right to retire (discontinue) a Service at any time with or without prior notice.

4. Account Access

Access to certain areas of the Website may be restricted. JenniferMaker LLC reserves the right to restrict areas of the Website at its sole discretion.

Some restricted areas of the Website may be made available to you as a registered user. When you are registered, you are required to create a user profile, which may include a username and password (“User Account”). You agree to keep your username and password confidential. You may not use as a username the name of another person or entity that is not lawfully available for use, a name or trademark that is subject to any rights or another person or entity or is offensive, vulgar or obscene. If you suspect your password has been compromised, you must notify JenniferMaker LLC immediately at [email protected]. JenniferMaker LLC will not be liable for any loss caused by the unauthorized use of your account; however, you may be liable to JenniferMaker LLC or other third parties for any losses incurred due to such unauthorized use.

When you create a User Account with JenniferMaker LLC, you guarantee that you are 18 years of age or older, are able to consent to these Terms of Use, and that the information you provide to us is accurate, complete, and current at all times. Violation of this paragraph may result in the immediate termination of your User Account without refund, in JenniferMaker LLC’s sole discretion.

JenniferMaker LLC may disable your username and password at its sole discretion, refuse to register a user for the Service, remove or edit any content contributed to the Website or cancel any User Account. Froese Media LLC may, without notice, refuse access to its Website, in whole or part, to any person that fails to comply with these Terms.

JenniferMaker LLC reserves the right to modify methods for registration and access levels of registered users from time to time.

5. Classrooms

Sharing or reselling items or files purchased through a classroom, as well as any other digital proprietary information that is the property of Jennifer Maker, is strictly prohibited. All files purchased from Jennifer Maker, aside from SVG cut files or PNG print files specifically designated to share or sell, are for personal use only. For each purchase of a course, only one user is allowed access to the course content. You may not purchase a course to share with another user.

6. Content

All text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, artwork, and computer code (collectively, “Content”), including but not limited to the design, structure, selection, coordination, expression, “look and feel,” and arrangement of such Content, contained on the Site is owned, controlled or licensed by or to Jennifer Maker with all rights reserved, and is protected by trade dress, copyright, patent and trademark laws, and various other intellectual property rights and unfair competition laws. All other trademarks, service marks and logos used in this Site are the trademarks, service marks or logos of their respective owners.

Except as expressly provided in these Terms of Use, no part of the Site and no Content may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, or distributed in any way (including “mirroring”) to any other computer, server, Website or other medium, for publication or distribution or for any commercial enterprise, without Jennifer Maker’s express prior written consent.

7. Bonus Content

From time to time, we may feature free bonus gifts with purchase. We have established a few simple rules that apply to this content. All bonus content is valid at our School and JenniferMaker.com only. All bonus content is subject to certain terms and conditions, which differ from offer to offer. We reserve the right to limit bonus content offered with products. Bonus content is a free gift with purchase -- you are not purchasing the bonuses. Bonus content is not redeemable for cash or credit. Bonus content is not eligible for returns or refunds. Previous purchases are not eligible for adjustments based on current offers.

8. Disclaimer

The materials on the School’s website are provided 'as is'. The School makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, the School does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.

While Jennifer Maker makes every effort to ensure that the information on this website is accurate, we can make no representations or warranties as to the accuracy or reliability of any information provided on this website. Similarly, while Jennifer Maker makes every effort to ensure that the images on this website are accurate, we can make no representations or warranties as to the accuracy or reliability of the images provided on this website. Jennifer Maker makes no warranties or representations whatsoever with regard to any product provided.

9. Limitations

In no event shall the School be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on the School’s website, even if the School or an authorized of the School has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

The materials appearing on the School’s website may include technical, typographical, or photographic errors. Any claim relating to the School’s website shall be governed by the laws of the School Owner’s home jurisdiction without regard to its conflict of law provisions.

Jennifer Maker does not seek or want to receive confidential or proprietary information from you through the Site. Please note that any information or material sent to Jennifer Maker through the Site will be deemed NOT to be confidential.
